These Terms of Use (“Terms”) form a binding agreement between you and Guide Healthcare Pty Ltd (“Guide Healthcare”, “we”, “us”, “our”) regarding your use of the Guide Connect mobile application (“App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, you must not use the App.
1. Eligibility
You must be at least 13 years old to use the App.
By using the App, you represent that you are legally able to agree to these Terms.
If you are using the App on behalf of an aged care provider, you confirm that you have authority to do so.
2. Purpose of the App
The App is designed for community engagement, activity tracking, and wellbeing events.
No Medical Advice: The App does not diagnose, treat, or provide medical advice. You should seek guidance from a qualified health professional before making health or exercise decisions.
You acknowledge that activities undertaken through the App may involve physical exertion and you participate at your own risk.
3. Accounts and Access
You must keep your login details (e.g. phone number, OTP codes) secure.
You are responsible for all activity under your account.
You agree to provide accurate information and update it if necessary.
We may suspend, restrict, or terminate access if we suspect misuse, unauthorized access, or breach of these Terms.
4. Acceptable Use
You must not:
Use the App in a way that is unlawful, misleading, or harmful.
Manipulate scores, events, or leaderboards.
Attempt to copy, reverse engineer, or interfere with the App’s code, APIs, or security features.
Upload or transmit viruses, malware, or harmful code.
Use the App in a way that could damage, disable, or impair our systems.
5. Data and Privacy
Your use of the App is also subject to our Privacy Policy, which explains how we collect, use, store, and protect your personal information. By using the App, you consent to such processing.
6. Intellectual Property
All rights in the App, its design, content, and software are owned by Guide Healthcare or our licensors.
You are granted a limited, non-exclusive, non-transferable licence to use the App for its intended purpose.
You may not copy, modify, reproduce, or distribute any part of the App without our written permission.
7. Disclaimer of Warranties
The App is provided “as is” and “as available.”
We make no warranties, express or implied, about the accuracy, reliability, availability, or fitness for a particular purpose of the App.
We do not guarantee that the App will always be uninterrupted, secure, or error-free.
8. Limitation of Liability
To the maximum extent permitted by law, Guide Healthcare and its officers, employees, and contractors are not liable for any direct, indirect, incidental, or consequential damages, including injury, loss of data, or loss of profits, arising from your use of the App.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g. Australian Consumer Law guarantees).
9. Indemnity
You agree to indemnify and hold Guide Healthcare harmless from any claims, losses, damages, or expenses (including legal fees) arising out of your misuse of the App or your breach of these Terms.
10. Termination
We may suspend or terminate your access to the App at any time if you breach these Terms or if we discontinue the App. Upon termination, your right to use the App ends immediately.
11. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
